I am speaking at the Spring Arbitration Symposium 2017 organised by Commercial Dispute Resolution (“CDR”). I am part of a panel addressing the topic of Tribunal Selection in a session which promises to be interesting and informative. This is a very important area; the ability of the parties to select members of the arbitral tribunal is just one of the features which sets arbitration apart from litigation.

Other topics addressed in the Symposium include the enforcement of arbitral awards and best practice in obtaining evidence in international arbitrations. There are also sessions devoted to energy and commodities as well as construction and engineering arbitrations.

Along with other members of ArbDB Chambers, I will be speaking at the Kuala Lumpur International Arbitration Week (“KLIAW 2017”) to be held at the Kuala Lumpur Regional Centre for Arbitration (“KLRCA”) from 15 – 17 May 2017.
KLIAW 2017 follows on from a similar highly successful event in 2015 which attracted almost 450 local and international ADR practitioners. Details of this year’s event can be found here: . Some highlights are: –

• The launch of KLRCA’s 2017 Arbitration Rules;
• Several interactive sessions on One Belt One Road;
• KLRCA’s annual Construction Industry Payment and Adjudication Act conference;
• An introduction to Dispute and Conflict Avoidance Boards; and
• Sessions focusing on Mediation, Islamic Arbitration and Investment Arbitration.
It will be a great honour to participate in this conference, which promises to be well organised, highly informative and interactive. The social events arranged by KLRCA are always of high quality and this year include a Gala Dinner.

In an interesting decision in the Technology and Construction Court in March 2017, the Judge (Mrs Justice Jefford) considered a challenge by an unsuccessful party in an ICC arbitration. The case which is related to a dispute over a contract to construct a power station in Kabul Afghanistan is Symbion Power LLC-v- Venco Imtiaz Construction Company [2017] EWHC 248 (TCC).

The largest arbitration award in history, totalling some US$ 50 billion in favour of the former majority shareholders in the Russian oil company Yukos, has been set aside by the Hague District Court. The basis of the court’s decision was that Russia, the Respondent in the arbitration, had never ratified the Energy Charter Treaty under which the claims had been brought. This was despite the fact that Russia had signed the Treaty in 1994, but the court held that this meant only that Russia was only bound by those provisions of the Treaty which were compatible with Russian law. Here, as the matters in issue were matters of public law, they could not be referred to arbitration and thus the arbitral tribunal lacked jurisdiction.

The Claimants have said they will appeal, so this is by no means the end of the case. This promises to be a long running saga given the huge amounts at stake.
